PORTLAND, Ore. | Oct. 27, 2026 — In a major victory for parental rights and free speech, the Liberty Justice Center’s (LJC) PARENTS Initiative has secured sweeping concessions from Portland Public Schools on behalf of Allison Roberts, a mother who was banned from her children’s elementary school after questioning its display of a transgender-inclusive Pride flag, objecting to gender-identity instruction, and speaking out about school policies that allow officials to withhold information from parents.
Just days before a scheduled hearing on Roberts’ motion for a preliminary injunction, Portland Public Schools agreed to reverse several of the actions challenged in her lawsuit, delivering a major victory for Roberts and resolving substantial portions of the immediate legal dispute. The settlement agreement addresses preliminary-injunction requests associated with two of the lawsuit’s three constitutional claims.
The dispute began when Roberts questioned the school’s decision to display a transgender-inclusive Pride flag and raised concerns about gender-identity instruction and policies affecting parental notification. After school officials rebuffed her concerns, Roberts peacefully distributed a letter to other parents from a public sidewalk. According to her lawsuit, district officials characterized her advocacy as harassment, investigated her, and ultimately barred her from campus. Roberts says the exclusion prevented her from attending her son’s fifth-grade graduation — a milestone she can never recover.
The victories include:
- Campus ban to be rescinded: Portland Public Schools has agreed to rescind the February 6, 2026, trespass notice that barred Roberts from her children’s school.
- Free speech rights recognized: The district has withdrawn its formal warning and expressly recognized Roberts’ First Amendment right to peacefully distribute literature on a public sidewalk and criticize school officials and policies.
- Curriculum exemptions secured: The district has agreed to promptly approve Roberts’ exemption requests for both of her children from LGBTQ2SIA+ curriculum and learning activities for the 2026-27 school year.
- District harassment policy under review: Portland Public Schools has agreed to review its Nondiscrimination/Anti-Harassment Policy within 60 days, including considering changes proposed by Roberts to ensure the policy is consistent with the First Amendment.
The breakthrough followed a settlement conference requested by the federal judge overseeing Roberts’ preliminary-injunction proceedings. Through those negotiations, LJC’s PARENTS Initiative secured substantial commitments from the district, resolving key requests for immediate relief and advancing the case toward a broader resolution.
But the broader fight for parental rights is far from over. Portland Public Schools continues to defend policies that, under certain circumstances, allow school officials to withhold information from parents about a child’s gender identity or social transition at school.
Although the district has agreed to protections for Roberts’ family, broader policy reforms remain unresolved. LJC continues to challenge the district’s nondisclosure policies and is pressing for protections that extend beyond one family. As negotiations continue, LJC is pressing the district to reform policies that it argues undermine parents’ fundamental right to direct their children’s upbringing and education. The case remains active, with a preliminary-injunction hearing scheduled for December 1, 2026.
“Portland Public Schools tried to silence a mother who dared to question what was happening in her children’s school. Now the district has agreed to withdraw its warning, rescind its campus ban, and recognize her right to speak freely,” said Timothy R. Snowball, lead attorney for the Liberty Justice Center’s PARENTS Initiative. “This is a major victory, not just for Allison Roberts, but for every parent who has been told to stay quiet and leave these decisions to school officials. But the fight is not over. The district continues to defend policies that allow school officials, under certain circumstances, to withhold important information from parents about their own children. Parents have the fundamental right to direct their children’s upbringing and education. We intend to keep fighting until those rights are protected.”
Through its PARENTS Initiative, the Liberty Justice Center defends the constitutional rights of parents to direct their children’s upbringing and education, challenges policies that exclude families from consequential decisions, and protects parents from government retaliation for speaking out.
The Roberts settlement agreement delivers meaningful protections for one Portland family. LJC’s ongoing litigation seeks to ensure that other parents do not have to file federal lawsuits to secure those same fundamental rights.
Parents who have been denied information about their children’s education, have been refused curriculum exemptions, or faced retaliation for speaking out are encouraged to contact the Liberty Justice Center through its PARENTS Tip Line. Parents in Portland Public Schools seeking exemptions from LGBTQ-related instruction, including those who have been told exemptions are unavailable, are also encouraged to reach out.
