(June 29, 2023 | Washington, D.C.) — Today the Liberty Justice Center is celebrating the Supreme Court’s decision in Students for Fair Admissions v. President and Fellows of Harvard College. The Court held that racially discriminatory admissions system used by Harvard College and the University of North Carolina violate the Equal Protection Clause of the U.S. Constitution.
Applauding the decision, Liberty Justice Center President Jacob Huebert stated: “Government should never discriminate against people based on their race. It shouldn’t have taken a Supreme Court decision to make universities recognize that, but we’re pleased that the Court has finally done so in this landmark decision.”
The Liberty Justice Center submitted an Amicus Brief to the Supreme Court supporting the challenge to the universities’ racial discrimination. The Liberty Justice Center’s brief argued that affirmative action is discriminatory and is an inefficient way to obtain diversity. It particularly noted the universities’ discrimination against Asians and Asian-Americans, and the universities’ failure to recognize the diversity among Asians and
Asian-Americans.
