WHAT: On November 8th, the United States District Court for the District of Wyoming will hold a preliminary injunction hearing in Cubin v. Gordon, a case challenging Governor Gordon’s violations of a Wyoming doctor’s First Amendment rights.
Liberty Justice Center Senior Counsel Buck Dougherty, in association with Wyoming counsel Steve Melchior, will present arguments to the court in favor of a preliminary injunction to restore Dr. Eric Cubin to his former position on the Wyoming Board of Medicine. Dougherty will urge the court to issue a ruling before the end of the year.

ISSUE BACKGROUND: In August, the Liberty Justice Center filed a First Amendment lawsuit on behalf of Dr. Eric Cubin, a radiologist whom Wyoming Governor Mark Gordon forced to resign from the Wyoming Board of Medicine for supporting Chloe’s Law—a bill which the Governor signed into law and has since publicly commended himself for enacting, stating that the law “recogniz[es] the need for our state to protect the most vulnerable.”
Despite his current support for Chloe’s Law, Governor Gordon removed Dr. Cubin from the Wyoming Board of Medicine in April for writing a letter to the state’s House of Representatives in support of the legislation.
The Liberty Justice Center’s lawsuit argues that the Governor engaged in illegal retaliation and violated Dr. Cubin’s First Amendment rights by firing the doctor for exercising his right to free speech. The lawsuit urges the court to reinstate Dr. Cubin and to issue a ruling upholding his First Amendment rights.
