Greater Las Vegas Short Term Rental Association v. Clark County

The City of Las Vegas has imposed extreme restrictions on short-term home rentalsthat is, rentals of homes for 30 days or fewer through platforms like Airbnb. In a blatant violation of the Fourth Amendment, the City forces property owners to submit to searches of their homes and turn over guest recordseven when there’s no suspicion of wrongdoing, let alone probable cause or a warrant. It also imposes discriminatory noise rules on rental properties, andin a measure clearly designed to protect casinos and hotels from competitionbans short-term rentals within 2,500 feet of a “resort hotel.”

The Liberty Justice Center joined with the Goldwater Institute to submit an amicus brief to the Nevada Supreme Court on September 12, 2023.
