The Liberty Justice Center has joined Advancing American Freedom to lead a broad coalition of organizations in support of the Keep Nine Amendment, a proposed constitutional amendment that would permanently establish the U.S. Supreme Court at nine justices.
The amendment is designed to protect the independence of the judiciary by preventing future presidents and Congresses from changing the size of the Supreme Court for political advantage. While Congress currently has the authority to alter the number of justices, the Court has consisted of nine members since 1869. The preservation of the Court’s composition ensures the maintenance of its role as an independent check on executive and legislative power.
The Liberty Justice Center continues its commitment to defend the Constitution and the entities that represent it by sending the letter urging Congress to prioritize consideration of the Keep Nine Amendment.
“Over the last year, Liberty Justice Center has fought to preserve the Constitution’s separation of powers and the checks and balances that protect individual liberty,” said Sara Albrecht, Chairman and CEO of the Liberty Justice Center. “That commitment extends to the judiciary. An independent Supreme Court is not a partisan objective—it is a constitutional necessity. Protecting the Court from political manipulation helps preserve the rule of law and the constitutional structure that safeguards our freedoms.”
The letter, sent on July 13, 2026 and signed by the Liberty Justice Center and more than 50 organizations, is available here.
