(The Federal Newswire)—In a recent decision, the U.S. Court of International Trade (CIT) ruled against the Trump administration’s “Liberation Day” tariffs, declaring them unlawful. The Liberty Justice Center, which challenged these tariffs on behalf of five small businesses in V.O.S. Selections, Inc. v. Trump, expressed approval of the ruling.
The CIT found that the International Emergency Economic Powers Act (IEEPA) does not grant the President unlimited authority to impose tariffs. It emphasized that such power lies with Congress and that any delegation must be clear and limited to avoid constitutional issues. The court’s decision affects all tariffs imposed under IEEPA by the Trump administration, including those on goods from China, Mexico, and Canada.
Jeffrey Schwab from the Liberty Justice Center said, “We’re delighted by the decision of the Court of International Trade enjoining the President’s so-called ‘Liberation Day’ tariffs.” He added that it reaffirms legal boundaries for presidential actions and protects businesses from volatile tariffs.
Co-Counsel Ilya Somin remarked on the court’s unanimous ruling against what he described as a “massive power grab” by the President. Plaintiff Victor Schwartz expressed his satisfaction with the outcome, viewing it as a victory for small businesses globally.
