The City of Las Vegas has imposed extreme restrictions on short-term home rentals—that is, rentals of homes for 30 days or fewer through platforms like Airbnb. In a blatant violation of the Fourth Amendment, the City forces property owners to submit to searches of their homes and turn over guest records—even when there’s no suspicion of wrongdoing, let alone probable cause or a warrant. It also imposes discriminatory noise rules on rental properties, and—in a measure clearly designed to protect casinos and hotels from competition—bans short-term rentals within 2,500 feet of a “resort hotel.”
