Biden v. Nebraska

On February 3, the Liberty Justice Center filed an amicus brief in Biden v. Nebraska, a case addressing the Biden Administration’s declaration of a state of emergency to forgive student loan debt. The amicus brief argues that Missouri has standing to sue the Biden Administration on behalf of the Higher Education Loan Authority of the State of Missouri (MOHELA), a quasi-public instrumentality of the state, because it is a creation of the Missouri state legislature. In addition, the brief argues that the Biden Administration cannot proclaim an economic crisis that justifies emergency relief for student debt borrowers while simultaneously touting historic economic successes, record investment, and strong job growth.
