Filed on behalf of Pennsylvania state employees, the federal class-action lawsuit, Schaszberger v. AFSCME Council 13, demands a refund of the nonmember fees employees. These fees were ruled unconstitutional by the U.S. Supreme Court in Janus v. AFSCME in June 2018.

HARRISBURG, Pa. — Pennsylvania state workers are seeking millions of dollars in refunds as part of a class-action lawsuit filed in federal court Thursday.
Like a previous lawsuit filed earlier this year, the workers say they were forced to pay union fees, even though they’re not union members.
Until earlier this year, David Schaszberger worked as a Pennsylvania government employee for more than a decade.
“It developed me as a professional and they gave me a lot of good opportunities to grow professionally,” Schaszberger said.
There was just one big problem.
Schaszberger says he was forced to pay union fees to Harrisburg-based AFSCME Council 13, even though he wasn’t a union member.
“I didn’t seek their representation, I didn’t want their representation, and I didn’t feel that they represented my interests anyway,” Schaszberger said. “So, to be forced to pay them as part of my job just didn’t seem right.”
